The notification of extension of Army Chief General Qamar Bajwa’s tenure has been suspended by the Chief Justice of Pakistan, Justice Asif Saeed Khosa. On August 19th, the notification was issued by the Prime Minister Imran Khan. It was reinforced last week.
The notification said, “General Qamar Javed Bajwa is appointed Chief of Army Staff for another term of three years from the date of completion of current tenure.”
There was a hearing of the petition against the extension in which CJP said that the due procedure is being followed adequately. So the notification is suspended until tomorrow.
Justice Khosa said that the premier can not extend the tenure of the Army Chief as it is only the prerogative of the President.
The attorney general told the court, “Army chief’s tenure was extended after the president’s approval.”
Chief Justice Pakistan said that only 11 have signed the summary out of 25 cabinet members.
Justice Khosa said, “Fourteen members of the cabinet did not give any opinion due to their absence.”
The petition was filed by the Jurist Foundation against the extension of the Army Chief. The full bench of the hearing included CJP Asif Khosa, Justices Mazhar Alam Miankhel, and Mansoor Ali Shah.
It is pertinent to mention here that the Army Chief General Bajwa will retire on Nov 29th.
