The Supreme Court of Pakistan has made it a must for men to give the haq mehr to their wives before they marry the second time.
A 2-member bench in its decision said that the husband would be required to pay the complete amount of the haq mehr that had been fixed at the time of marriage as soon as he decides to enter the second marriage without asking permission either from their first wife or the arbitration council.
This major directive has come after a man filed an appeal in the apex court against the Peshawar High Court decision. The Peshawar High Court had directed the man to give his wife the complete amount of the haq mehr as he contracted a second marriage without taking the permission of his first wife.
The 2-member bench dismissed the appeal of the man and upheld the decision of the PHC.
The apex court referred to the section 6 of the Muslim Family Law Ordinance, 1961 and mentioned that it does not place any limitation on men to get into the second marriage contract however it does ask men to take permission from their wives.
