CII Chief Suggests Making Triple Talaq a Punishable Crime

On Thursday, the Council of Islamic Ideology has suggested that the action of triple talaq should be referred to as a punishable crime.

While responding to a question by Member of National Assembly MNA Bashir Virl, CII Chairman—Dr Qibla Ayaz informed to the Standing Committee of the National Assembly on Law and Justice that the divorce takes when the word “talaq” is spoken thrice in one go even if has been done in joke.

Farogh Naseem—the federal law minister said that there was precedence in Islamic history of such an act being punished by the state, uttering that the second caliph of Islam—Hazrat Umar (RA) had punished the ones who performed the act of giving instant divorce.

He said that keeping that in mind the NA could make laws for making this act a punishable crime.

While endorsing Dr Ayaz, thelaw minister said that triple talaq should be made punishable in Fiqah Hanafi.

The punishment has not been determined yet, as per the minister if the ministry of law agrees to the suggestion of making it a punishable offence, the punishment could also be determined.

The law minister also said that making triple talaq a punishable crime would become another source via which the police would be asking for bribes.

He added that if divorce is not some crime, then such ruling should be avoided.

The committee delayed the discussion on the legislative about divorce as well as that on the inheritance until next meeting.
